Terms and Conditions of Sprayfunds

  1. Introduction

    Welcome to Sprayfunds, a digital celebration finance platform enabling seamless, secure, and lawful monetary gifting ("spraying") at events. These Terms and Conditions ("Agreement") govern your access to and use of the Sprayfunds platform, mobile application, web services, and associated financial systems (collectively, "Services"). By accessing our Services, you irrevocably accept all terms, representations, conditions, and policies herein, which shall be legally binding and enforceable under all applicable laws.

  2. Eligibility and Registration

    Users must be 18 years or older and possess full legal capacity to enter into binding agreements. Registration requires accurate and verifiable information. Sprayfunds reserves the right to refuse, suspend, or terminate accounts found to contain false or misleading data.

  3. Use of the Platform

    Users agree to use the platform solely for lawful and celebratory digital gifting purposes. Any abuse, fraud, impersonation, unauthorized use, reverse engineering, or attempt to bypass platform security constitutes a material breach and may attract criminal prosecution and/or permanent ban.

  4. Funding and No-Refund Policy

    All funds loaded into a user's Sprayfunds account are deemed final and non-refundable. Sprayfunds shall not issue charge backs, cancellations, or reversals once an account has been credited. Users are advised to verify all transaction details before initiating a wallet top-up. Any claim of mistaken top-ups, errors, or misdirection shall not constitute grounds for refund under any circumstances.

  5. Digital Spraying & Service Fees

    All digital sprays must be made exclusively through Sprayfunds' official platform and payment infrastructure. No user is permitted to execute sprays via external channels, cash handovers, third-party agents, or unofficial systems.

    Sprayfunds shall retain ten percent (10%) of all funds sprayed at any event as a standard service and processing fee. This fee is irrevocable and shall be deducted automatically from each transaction prior to settlement with the recipient.

  6. Cash Prohibition

    Sprayfunds strictly prohibits the physical handling, acceptance, or collection of cash at events. All celebratory contributions must be processed digitally through the app. Any individual or third party purporting to collect cash on behalf of Sprayfunds is acting unlawfully and without authorization.

  7. Authorized Payment Channels

    All transactions must be processed via Sprayfunds’ recognized payment gateways, wallets, or affiliated fintech integrations. Any attempt to bypass official payment infrastructures (including peer-to-peer deals or direct bank transfers to recipients) is a breach of this Agreement.

  8. Platform Commission & Liability

    Users agree that Sprayfunds’ 10% commission is a mandatory charge for the convenience, infrastructure, compliance, and automation it provides. Sprayfunds shall not be liable for loss of access, misdirected payments, or event disruptions attributable to third-party systems, force majeure, or user negligence.

  9. User Conduct and Enforcement

    Sprayfunds reserves the right to monitor, audit, restrict, suspend or terminate any account or transaction suspected to involve:

    • Money laundering or illicit finance
    • Identity theft or misrepresentation
    • Bot activity or unauthorized API access
    • Harassment or misconduct at live events
    Violation of any provision herein may attract account seizure, permanent ban, refund forfeiture, and legal proceedings.

  10. Intellectual Property Rights

    All platform content, including but not limited to brand names, interface designs, animations, codebases, and data architecture, remain the exclusive intellectual property of Sprayfunds. Unauthorized reproduction, licensing, or duplication is strictly prohibited.

  11. Disclaimer & Limitation of Liability

    The platform is provided on an "AS IS" and "AS AVAILABLE" basis. Sprayfunds makes no representations or warranties regarding uninterrupted service, accuracy of real-time metrics, or availability of external APIs.

    In no event shall Sprayfunds be liable for indirect, consequential, incidental, or punitive damages including data loss, earnings disruption, or reputational damage resulting from platform use.

  12. Modifications to the Terms

    Sprayfunds reserves the right to amend, modify, or update these Terms at its sole discretion. Users are advised to review the Terms periodically. Continued use of the platform constitutes binding acceptance of any updates.

  13. Governing Law and Jurisdiction

    This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Sprayfunds is incorporated. Any dispute shall be subject to the exclusive jurisdiction of competent courts therein.
